Terms and Conditions (T&C) – KC Dance Studio Basel
1. Scope of Application
These Terms and Conditions (T&C) apply to all dance classes, workshops, training sessions, events and any other services (collectively “Courses”) offered by KC Dance Studio, Spalentorweg 11, 4051 Basel (“KCDS”).
2. Registration and Conclusion of Contract
2.1 Registration is made via Eversports and becomes binding upon confirmation by KCDS.
2.2 There is no entitlement to attend a specific Course. KCDS may assign participants to different groups based on level, capacity and organisational considerations.
2.3 A separate registration is required for each participant. No guarantee is provided for a fixed dance partner.
2.4 Minors must be registered by a legal guardian, who thereby becomes the contractual party.
2.5 Trial classes require advance registration; the fee is CHF 30 per class.
3. Payment Terms and Course Fees
3.1 Registration constitutes a binding obligation to pay the full Course fee.
3.2 Current prices and conditions are listed on Eversports and must be paid prior to Course commencement.
3.3 KCDS may charge reminder fees of CHF 15 per reminder for outstanding payments and may deny participation until all balances are settled.
3.4 Non-attendance, illness, holidays, or premature withdrawal do not entitle participants to a refund or fee reduction.
3.5 For choreography-based Courses, additional expenses (e.g., costumes, travel) are not included in the Course fee.
3.6 Force Majeure: In the event of natural disasters, pandemics, official restrictions or similar circumstances, KCDS may adjust, postpone or move classes online. Refunds are excluded.
4. Memberships
4.1 Half-Year Memberships (6 months):
– Six monthly instalments are charged.
– The membership automatically pauses during the summer break (approx. 1 July – 15 August).
– Membership pricing is adjusted accordingly.
4.2 Annual Memberships (12 months):
– Twelve monthly instalments are charged even during holiday closures.
– Pricing reflects and incorporates scheduled closing periods.
4.3 Freeze Option:
Memberships of six months or longer may be frozen once for one month. Requests must be submitted by email at least seven days in advance. The frozen month is added to the contract term.
4.4 Memberships and tickets are personal and non-transferable.
5. Illness and Special Circumstances
5.1 Illness, relocation or other personal circumstances do not release participants from their contractual obligations.
5.2 In cases of documented long-term medical conditions, an individual arrangement may be granted at KCDS’s discretion (goodwill).
5.3 If a Course cannot take place due to insufficient enrolment or organisational reasons, participants will be informed. Fees already paid will be refunded unless a reasonable alternative Course is accepted.
6. Missed Lessons
Missed lessons cannot be refunded or made up at a later date. Absence should be communicated to KCDS.
7. Participant Conduct and Responsibilities
7.1 KCDS may exclude participants without refund in cases of gross misconduct (e.g., intoxication, violence, harassment, disrespectful behaviour).
7.2 Participants are liable for damage they cause intentionally or negligently.
7.3 Choreographies, dance figures and teaching content may not be shared, reproduced or taught to third parties.
7.4 KCDS must be informed immediately in case of contagious illness.
7.5 Filming and photography during lessons are prohibited unless explicitly authorised by KCDS and all persons concerned.
8. Rights of KCDS (Operational Adjustments)
KCDS reserves the right to merge classes, reschedule lessons, change instructors, or move lessons to other premises, provided the purpose of the Course is preserved.
9. Studio Closures, Holidays and Public Holidays
9.1 The studio is closed annually approximately from 20 December to 10 January and from 1 July to 15 August. Dates may vary slightly and will be announced.
9.2 No regular classes take place during the Basel Carnival (Basler Fasnacht).
9.3 The studio remains closed on all official public holidays.
9.4 Membership fees are calculated with these closure periods in mind. No refunds are granted.
10. Liability
10.1 Participation in Courses and presence on the premises is at the participant’s own risk.
10.2 Participants are responsible for maintaining adequate accident and liability insurance.
10.3 KCDS shall only be liable for damage caused intentionally or by gross negligence. For slight negligence, liability is limited to breaches of essential contractual duties and restricted to foreseeable, typical damage.
10.4 These limitations also apply to the personal liability of KCDS staff and representatives.
11. Photo and Video Recordings / Data Protection
11.1 By registering, participants consent to the creation and use of photo and video material taken during Courses or events, which may be used by KCDS for promotional purposes (website, social media, print and digital media).
11.2 In the case of minors, the legal guardian provides this consent.
Note: Under Swiss data protection law, consent may be revoked with effect for the future (not retroactively).
12. Amendments to the T&C and Services
12.1 KCDS may make changes to schedules, offerings or facilities for organisational reasons.
12.2 Amendments to these T&C will be communicated in writing. If the participant does not object within one month, the amendments are deemed accepted.
13. Applicable Law and Place of Jurisdiction
These T&C and all contractual relationships with KCDS are governed by Swiss substantive law.
The exclusive place of jurisdiction is Basel-Stadt, Switzerland.

No Right of Withdrawal
The customer acknowledges that there is no statutory right of withdrawal for leisure services that are scheduled for a specific date or time period. By booking a dance class, the customer commits to paying the full course fee, even if they do not attend individual sessions.
