Terms and Conditions (T&C) – KC Dance Studio Basel

1. Scope

These Terms and Conditions (T&C) apply to all dance classes, trainings, workshops, events, and other offerings (hereinafter “Courses”) conducted by KC Dance Studio, Spalentorweg 11, 4051 Basel (hereinafter “KCDS”).

2. Registration and Contract

2.1 Registration is made via Eversports and becomes binding only upon confirmation by KCDS.
2.2 There is no entitlement to attend a specific Course. KCDS may assign participants to different groups based on level, capacity and organisational considerations.
2.3 A separate registration is required for each participant. No guarantee is given for a fixed dance partner.
2.4 Minors must be registered by a legal guardian, who thereby becomes a contractual party.
2.5 For trial lessons, registration is required; the fee is CHF 30 per lesson.

Student discount: Student offers can only be redeemed if the student ID is sent by email to [email protected] before the first participation. Otherwise, the difference will be charged and the full course fee must be paid.

3. Payment Terms and Course Fees

3.1 By registering, the participant undertakes to pay the full course fee.
3.2 Current prices and conditions are visible on Eversports and are due before the course starts.
3.3 In case of outstanding payments, KCDS may charge reminder fees (CHF 15 per reminder) and refuse participation.
3.4 Non-attendance, illness, holidays, or early termination do not entitle participants to discounts or refunds.
3.5 Additional costs (costumes, travel, etc.) are not included in choreography courses.
3.6 Force majeure: In events such as natural disasters, pandemics, or official orders, KCDS may reschedule, adapt, or conduct courses online. No refund is due.

4. Memberships

4.1 Half-year membership (6 months):
– 6 monthly payments will be charged.
– Membership automatically pauses during the summer break (approx. 01.07.–15.08.).
– Payment structure is adjusted accordingly.

4.2 Annual membership (12 months):
– 12 monthly payments will be charged, including holidays and closures.
– Prices are adjusted to account for closure periods.

4.3 Pause:
For contracts of 6 months or longer, a single 1-month pause can be requested at least 7 days in advance via email. The month will be added to the contract period.

4.4 Flex Pass:
The 10 lessons of a Flex Pass must be used within 5 months from the validity date, including holidays. Details are provided in the respective tickets and offers on Eversports. Unused lessons cannot be made up or refunded.

4.5 Memberships and tickets are personal and non-transferable.

5. Illness and Special Circumstances

5.1 Illness, relocation, or other personal reasons do not release the participant from contractual obligations.
5.2 In documented long-term health restrictions, individual solutions may be agreed upon (goodwill).
5.3 If a course cannot take place due to insufficient participants or organizational reasons, KCDS will inform the participants. Already paid fees will be refunded if no reasonable alternative is accepted.

6. Missed Lessons

Missed lessons cannot be made up or refunded. Absences must be communicated to KCDS.

7. Conduct and Participant Obligations

7.1 Grossly inappropriate behavior (alcohol, violence, harassment, disrespect, etc.) may lead to exclusion without refund.
7.2 Participants are liable for damages caused intentionally or negligently.
7.3 Sharing of learned steps and choreography is prohibited.
7.4 Participants must immediately inform KCDS of contagious diseases.
7.5 Filming or photographing in class is only allowed with explicit consent from KCDS and all affected persons.

8. KCDS Rights

KCDS may merge, reschedule, cancel courses, replace teachers, or change locations as long as the course purpose can still be fulfilled.

9. Studio Closures, Holidays, and Breaks

9.1 The studio is closed annually approx. 20.12.–10.01. and 01.07.–15.08. Exact dates may vary and will be communicated.
9.2 No regular classes are held during Basel Carnival.
9.3 The studio remains closed on all public holidays.
9.4 Membership fees already account for these closures; no refunds are due.

10. Liability

10.1 Participation and presence are at the participant’s own risk.
10.2 Participants are responsible for adequate accident and liability insurance.
10.3 KCDS is only liable for damages caused by gross negligence or intent. Liability for slight negligence exists only for essential contractual obligations.
10.4 This limitation also applies to employees and representatives of KCDS.

11. Photos, Videos, and Data Protection

11.1 By registering, participants consent to KCDS using photos and videos taken during courses or events for its own purposes (e.g., website, social media).
11.2 For minors, the consent is provided by the legal guardians.
11.3 Consent may be revoked, but the revocation only applies to future use (Swiss data protection law).

12. Communication

12.1 Contact via WhatsApp or social media does not replace official notification by email to [email protected].
12.2 Cancellations or other notifications must be sent by email. KCDS assumes no responsibility for messages sent via social media.

13. Amendments

13.1 KCDS may adjust offerings, course times, or locations.
13.2 Changes to the T&C will be communicated in writing. If the participant does not object within one month, they are deemed accepted.

14. No Right of Withdrawal

The participant acknowledges that for leisure services scheduled for a specific date or period, there is no statutory right of withdrawal or cancellation. By booking a dance course, the participant commits to paying the course fee even if they do not attend individual lessons.

15. Governing Law and Jurisdiction

Swiss law applies. Jurisdiction is Basel-Stadt.
