Terms & Conditions

1. Scope

These Terms and Conditions apply to all dance classes, workshops, and events (hereinafter referred to as “Courses”) offered by KC Dance Studio, Spalentorweg 11, 4051 Basel (hereinafter referred to as “KCDS”).

2. Registration

Participation in a course requires a completed registration. This is done through Eversports (https://www.eversports.ch/s/kc-dance-studio-basel) and must be confirmed by KCDS. There is no right to participate in a specific course. KCDS reserves the right to assign participants to different courses based on their skill level and availability. Registrations can be made individually or as pairs, with a separate registration required for each person. A guarantee for a fixed dance partner cannot be provided. For minors, registration must be completed by a legal guardian, who automatically becomes a contractual partner of KCDS by signing. A registration is also required for a trial lesson, which costs 30 CHF per session.

3. Payment Terms, Course Fees

Registration for a course is binding and obligates payment of the full course fees. The current fees can be found in the course program and apply per person. Fees are due before the start of the course and must be paid upon registration via Eversports. KCDS reserves the right to remind participants of outstanding payments and to charge a reminder fee of 10 CHF per reminder. Offers and discounts cannot be combined unless explicitly stated. Non-attendance at a lesson does not relieve the participant from the obligation to pay. Similarly, not utilizing lessons or prematurely discontinuing lessons does not exempt participants from their payment obligations. Course fees for choreography courses include only the specified training sessions; costs for costumes, travel, etc. will be charged separately. In case of extraordinary events or force majeure, such as natural disasters, strikes, wars, earthquakes, or pandemics, KCDS reserves the right to adjust course content, postpone lessons, or temporarily conduct classes online. There is no right to a refund of course fees in such cases.

4. Memberships  

For contracts with a duration of 6 months or more, participants may request a one-time pause of one month. This request must be made via email at least 7 days in advance. During the pause, the monthly fee will be suspended and added to the end of the contract duration. If a member fails to make payments, whether partially or late, participation in courses may be denied until all outstanding amounts are settled. Memberships and tickets are non-transferable.

5. Illness and Other Circumstances  

Illnesses, relocations, etc., do not relieve participants of their contractual obligations. In documented exceptional cases, such as chronic illness, early withdrawal may be agreed upon with KCDS. A move outside the service area of KCDS does not terminate the obligation to pay. If a course is full or insufficient participants are registered, participants will be notified, and any fees already paid will be refunded, unless an alternative course is chosen.

6. Missed Lessons

Missed lessons cannot be made up or refunded. KCDS must be informed of any absence from lessons.

7. Obligations of Participants

In cases of grossly inappropriate behavior (e.g., drunkenness, violence, insults), participants may be excluded from further lessons without a refund of course fees. Each participant is responsible for their actions and will be held liable for any willful damage. Participants shall indemnify KCDS from any costs incurred by third parties due to their misconduct. The figures and steps learned during classes may not be taught to others, either for free or for a fee. Participants must promptly inform KCDS of any contagious diseases. Filming and photographing during lessons are prohibited to protect the personal rights of other participants and instructors. Violations may result in exclusion from classes and claims for damages.

8. Rights of KCDS 

KCDS may combine, cancel, or relocate courses for operational reasons (e.g., low enrollment, instructor illness). The conditions for proper instruction apply even in cases of changes in instructors or locations. KCDS is entitled to change the locations or times of courses and to replace instructors as necessary.

9. Liability 

Dancing and being present in KCDS premises is at the participants’ own risk. Participants are responsible for ensuring adequate accident and liability insurance coverage. KCDS excludes all liability for personal or property damages not caused by KCDS or its employees. KCDS is only liable for gross negligence or intent, as well as for slightly negligent breaches of essential duties that jeopardize the purpose of the contract. In such cases, liability is limited to foreseeable, typical contractual damages. This limitation of liability also applies to the personal liability of KCDS employees and representatives.

10. Film and Photo Recordings (Data Protection) 

By registering, participants irrevocably consent to the use of their data and the creation, distribution, and publication of images (e.g., photo and video recordings) taken during courses or events by KCDS. KCDS is entitled to use these recordings for its own purposes, particularly for advertising across all current and future media (e.g., website, social media). For registrations of minors, legal guardians grant consent for the use of corresponding recordings.

11. Final Provisions

Changes to offers, schedules, and course structure remain reserved. Deviating agreements must be documented in writing to be valid. KCDS is entitled to amend these T&Cs and the existing contract as long as the changes are reasonable for the participant. If a participant does not object to a change within one month of notification, consent is deemed granted.

12. Applicable Law and Jurisdiction

Swiss law applies to all legal relationships with KCDS. The place of jurisdiction is Basel.
